Trials - Family protection trials

Family protection trials are trials that provide protective measures as to domestic violence, etc. among certain family members through adjustment of the environment, and correction of actions.

In the event of domestic violence among spouses, immediate family members, etc., which entails physical, mental or property damage, the prosecutor or the court, etc., may submit the matter to the family court. The family protection measures aim to recover the peace and stability in a family that has been affected by domestic violence thereby fostering a healthy family.

If the family court deems it necessary for the smooth investigation and deliberation of family protection case or for the protection of the victim, it may order the offender to be removed or quarantined from the residence or rooms of the family members, or to be restrained from approaching within 100 meters of the residence of the victims. Also, the family court, in principle, firstly has the family protection investigation officer to conduct an investigation regarding such case, and then, based on deliberations of such investigation, makes its final decision. The final decision may include orders restraining the offender from approaching the victim, restricting the exercise of parental rights in the event the offender is a parental rights holder, ordering community service or taking of classes, probation, commission to a are and custody of a third party, to a medical treatment or to a consultation. These measures may be imposed accumulatively.
