Provisional attachment/provisional disposition procedure
If a debtor hides or disposes of his/her assets before the judgment creditor commences judgment enforcement, the creditor is obstructed from seeking payment. Therefore, the steps taken by the court in order to prevent such attempts and to secure the debtor’s property are the provisional seizure and provisional disposition. If there is a need to preserve the enforcement against monetary claim, the court may order the debtor’s property to be put under provisional seizure. Provisional disposition may be granted for the purpose of setting the temporary state of affairs in regard to disputed legal relations or preserving the enforcement on the claim for delivery of specific immovable or movable property.
